Description of the Dinersville Service

Dinersville acts as an intermediary between the User and the Partners and provides a platform on which the User can purchase meals from the restaurants and eat-in. We do not offer any delivery services. Dinersville platform provides real-time information of meals in the restaurants such as Lunches, weekly lunch menu, a la carte menu, deals and offers which can be purchased using Dinersville services.

The restaurants (partner) provides all the meal and price information been added to our portal, also they are responsible for up-to- date information about their restaurants. Before any purchase, you should make sure all the information is correct and you agree to the terms and condition.The partner is responsible for checking that all your purchases & payments have met the criterial of purchase.

The User may encounter information that might be inaccurate, incomplete, delayed, misleading. Dinersville does not review content provided by the Partners always. Dinersville is not responsible for third parties' (including the Partners') content or information or for any damages arising as a result of the use of or reliance on it.

User Account

In order to have full access to Dinersville Service, the User must create a user account by following the registration instructions in the Dinersville App. The Dinersville Service credentials are personal and protected. The User shall ensure that any user account credentials and equivalent information required to access the user account of the User are kept confidential and used in a secure manner not accessible by third parties. A User can have only one user account.

Using or attempting to use another person’s Dinersville account/payment information without the consent of the owner is prohibited.

The user should not create a fake identity to use Dinersville service.

Dinersville have the right to revoke access or permanently remove user account if I. The User abuses the system II. Makes a false payment

You agree that we may use the information you have entered or saved, to process your order and for marketing and credit control purposes. Purposes which also may be included, for example, are:. To provide your information to third parties where we think that their services are interesting for you, or if this is necessary to provide our Services.

PAYMENT

In order to use the Dinersville Services, you must use valid credit card or other payment method information. You agree to pay for all purchases arising from your use. You must keep your credit card and other payment information that you have submitted to your user account updated.

COMPLAINS

We take complaints very seriously and strive to reply within five days. All complaints should be mailed to: support@dinersville.com

ORDERS

All purchased orders through Dinersville service can only be redeemed in the restaurant. (Takeaways’ can be negotiated between You and the restaurants)

All purchased orders that has not been used can be seen under the Navigation tab name: ORDERS.

All purchased orders should be shown to the cashier, the cashier has the right to confirm the payment.

LIMITATION OF LIABILITY

We take much care and attention to the information displayed on Dinersville.com. We apologize for any errors or omissions on our Website. We cannot guarantee that use of this Website will always happen smoothly. We cannot guarantee that this Website is free of viruses or bugs. We cannot guarantee the full functionality, accuracy and reliability, and we exclude all liability for accuracy and use of this Website.

By accepting these Terms and Conditions you agree to relieve us from any liability whatsoever arising from your use of information from any third party, or your use of any third party website, or your consumption of any food or beverages from a Participating Restaurant.

We exclude all liability for our Goods and / or Services. This does not affect your statutory rights as a consumer. Should we be held responsible for losses and / or damages suffered by you, such responsibility will be limited to the amount you have paid for the costs and / or Services. We are not liable for damages, costs, releases and / or other (in)direct losses (including loss of profit) arising in any way whatsoever. This limitation of liability does not apply in case of personal injury or death that is the direct result of negligence.

We are not responsible for errors, omissions, or loss of transmitted information, viruses or other infections or destructive products that affect your computer from our Website, phone or tablet.

We are not liable for errors or delays of our Services, by acts or omissions beyond our reasonable control, such as a natural disaster or an act / omission of a third party.

The Goods or meals sold through Dinersville services are for your own use. Therefore, we are not liable for any (in)direct loss, loss of data, loss of income or profit, loss or damage caused to property and / or loss by third parties arising from the use of this Website or any Goods or Services purchased through us.

We have taken all possible care to prevent Internet fraud and ensure that all data is stored as safely as possible. However, we exclude any liability for the unlikely event that a third party has hacked or broken into our network, devices, servers or those of third parties.

CANCELLATION

If you want to cancel an order you must immediately contact our support@dinersville.com. Your cancellation should include your order number and the reason for cancellation. If the Participating Restaurant accepts your cancellation, no cancellation fee will be charged. If the Participating Restaurant refuses the cancellation because e.g. the order has already been prepared, the cancellation will not be accepted. We will certainly never be able to cancel an order that has already been picked up by the User.

If the cancellation is done on time and accepted by the Participating Restaurant, we will refund your payment to your credit or debit card within 14 days.

In the unlikely event that the wrong order is ordered, you have the right to negotiate with the restaurant. If the Participating Restaurant can only prepare a part of your order e.g. because certain Goods are not in stock, then the staff of the Participating Restaurant will contact you and ask if you would like to replace this part of your order by something else or if you would like to be repaid for the missing Goods. We are not responsible for incorrect or partial orders. This issue should be discussed directly with the Participating Restaurant.
